1. Agreement to Terms
By accessing or using ListOrWait.com (the "Site"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Site. These Terms apply to all visitors, users, and others who access or use the Site. The Site is operated by Casavedo LLC, a Texas limited liability company ("Company," "we," "us," or "our").
2. Description of the Site
ListOrWait.com provides an informational market scoring tool designed to help homeowners evaluate current real estate conditions in their local area. The tool uses publicly available market data and a proprietary algorithm to generate a signal indicating whether current conditions are more favorable for listing a home or for waiting. The Site also provides an AI-generated explanation of market conditions and a calculator for estimating home sale proceeds. All content is for informational purposes only.
3. Not Professional Advice
THE LIST OR WAIT SCORE, THE AI-GENERATED EXPLANATION, THE EQUITY CALCULATOR, AND ALL OTHER CONTENT ON THIS SITE ARE PROVIDED FOR INFORMATIONAL PURPOSES ONLY AND DO NOT CONSTITUTE FINANCIAL, REAL ESTATE, TAX, LEGAL, OR INVESTMENT ADVICE. THE SCORE IS A DATA-DRIVEN MARKET SIGNAL, NOT A PERSONALIZED RECOMMENDATION. NO CONTENT ON THIS SITE SHOULD BE RELIED UPON AS THE BASIS FOR ANY REAL ESTATE TRANSACTION OR FINANCIAL DECISION. ALWAYS CONSULT A LICENSED REAL ESTATE PROFESSIONAL, ATTORNEY, OR QUALIFIED FINANCIAL ADVISOR BEFORE MAKING ANY DECISION RELATED TO BUYING, SELLING, OR FINANCING REAL PROPERTY.
4. Data Accuracy and Limitations
The data used to generate the List or Wait Score is sourced from third-party providers and may be delayed, incomplete, or subject to revision. Market conditions can change rapidly, and the score reflects conditions as of the data date shown in each report. The Company makes no representations or warranties about the accuracy, reliability, timeliness, or completeness of any data, score, estimate, or other content presented on the Site.
Property value estimates (AVM) are algorithmic approximations based on comparable sales and market data. They may differ substantially from actual market value and should not be used as the sole basis for pricing a home or making any financial decision.
5. Acceptable Use
You may use the Site for your personal, non-commercial informational use only. You agree not to:
- Use the Site for any unlawful purpose or in violation of any applicable laws or regulations
- Systematically scrape, harvest, or extract data from the Site using automated tools or scripts
- Attempt to interfere with, disrupt, or gain unauthorized access to the Site or its systems
- Use the Site to transmit any harmful, offensive, or unsolicited communications
- Reproduce, distribute, or create derivative works from Site content without our prior written consent
- Resell, sublicense, or commercially exploit any content or data obtained through the Site
6. Intellectual Property
All content on this Site, including but not limited to the List or Wait Score methodology, brand name, logo, design, text, graphics, and software, is owned by Casavedo LLC or its licensors and is protected by applicable intellectual property laws, including copyright and trademark law. Nothing in these Terms grants you any right, title, or interest in the Site or its content beyond the limited right to use the Site as described herein.
7. Third-Party Services
The Site relies on third-party data providers and technology services to operate, including Federal Reserve Economic Data (FRED), RentCast, Anthropic Claude AI, Google Analytics, and Neon database services. The availability, accuracy, and performance of the Site depends in part on these third-party services. We are not responsible for any failure, interruption, inaccuracy, or unavailability arising from third-party service issues. Your use of any third-party service linked to or integrated with the Site is subject to that service's own terms and privacy policy.
8. Advertising
The Site may display advertising provided by Google AdSense and other advertising networks. Advertising content is provided by third parties and does not constitute an endorsement, sponsorship, or recommendation by Casavedo LLC of any advertised product, service, or company. We are not responsible for the content, accuracy, or claims made in any advertisement displayed on the Site.
9. Disclaimers of Warranty
The site and all content are provided "as is" and "as available" without warranty of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that the site will be uninterrupted, error-free, secure, or free of viruses or other harmful components. We do not warrant that any score, estimate, or data presented on the site is accurate, complete, or current.
10. Limitation of Liability
To the maximum extent permitted by applicable law, Casavedo LLC and its members, managers, officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages arising from your use of, or inability to use, the site or its content, even if we have been advised of the possibility of such damages. In no event shall the total cumulative liability of Casavedo LLC to you for all claims arising from or related to these terms or your use of the site exceed one hundred dollars ($100.00).
11. Indemnification
You agree to indemnify, defend, and hold harmless Casavedo LLC and its members, managers, officers, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with: (a) your use of or access to the Site; (b) your violation of these Terms; (c) your violation of any third-party right, including any intellectual property or privacy right; or (d) any claim that content you submitted or transmitted caused damage to a third party.
12. Dispute Resolution
Informal Resolution. Before initiating any formal legal proceeding against Casavedo LLC, you agree to contact us at legal@listorwait.com to describe the dispute and attempt to resolve it informally. We will make a good faith effort to resolve the dispute within 30 days of receiving your written notice.
Binding Arbitration. If the parties are unable to resolve the dispute informally within 30 days, both parties agree to resolve the dispute through final, binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules, as modified by these Terms. The arbitration shall be conducted in Travis County, Texas, unless the parties agree otherwise. The arbitrator's decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.
Class Action Waiver. You waive any right to bring or participate in any class action lawsuit, class-wide arbitration, or any other representative or consolidated proceeding against Casavedo LLC. All disputes must be brought on an individual basis only.
Exceptions. Either party may seek emergency injunctive relief from a court of competent jurisdiction to prevent irreparable harm pending arbitration.
13. Governing Law
These Terms are governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions. Any dispute not subject to arbitration under Section 12 shall be resolved exclusively in the state or federal courts located in Travis County, Texas, and you consent to the personal jurisdiction of those courts.
14. Termination
We reserve the right, in our sole discretion, to terminate or suspend your access to the Site at any time, with or without notice, for any reason, including if we reasonably believe you have violated these Terms. Upon any termination, your right to use the Site will immediately cease. All provisions of these Terms that by their nature should survive termination will survive, including Sections 6, 9, 10, 11, 12, and 13.
15. General Provisions
Entire Agreement. These Terms constitute the entire agreement between you and Casavedo LLC regarding your use of the Site and supersede all prior agreements and understandings.
Severability. If any provision of these Terms is found by a court or arbitrator to be invalid, illegal, or unenforceable, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.
No Waiver. Our failure to enforce any provision of these Terms on any occasion shall not be deemed a waiver of our right to enforce that provision on any future occasion.
Updates to Terms. We may update these Terms from time to time. When we make material changes, we will update the effective date at the top of this page. Your continued use of the Site after any change constitutes your acceptance of the revised Terms.
